WEBSITE TERMS AND CONDITIONS OF USE


1. About the Website

Welcome to UEC Equipment Hire (Website). The Website provides dry hire of earthmoving and construction equipment (Services).

The Website is operated by Urban Earth & Civil Pty Ltd T/A UEC Equipment Hire (ABN 90 638 268 916). Access to and use of the Website, or any of its associated products or services, is provided by Urban Earth & Civil Pty Ltd T/A UEC Equipment Hire. Please read these terms and conditions (Terms) carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of Services, immediately.

Urban Earth & Civil Pty Ltd T/A UEC Equipment Hire reserves the right to review and change any of the Terms by updating this page at its sole discretion. When we update the Terms, we will use reasonable endeavours to provide you with notice of updates. Any changes to the Terms take immediate effect from the date of their publication.

2. Acceptance of the Terms

You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by UEC Equipment Hire in the user interface.

3. Equipment Hire Bookings

To make equipment hire bookings through our Services, you may be required to provide personal information about yourself, including:

  • Email address
  • Telephone number
  • Full name
  • Valid driver's licence details
  • Project location and requirements

You warrant that any information you give to UEC Equipment Hire will always be accurate, correct and up to date.

You may not use the Services and may not accept the Terms if:

  • You are not of legal age to form a binding contract with UEC Equipment Hire; or
  • You are a person barred from receiving the Services under the laws of Australia or other countries including the country in which you are resident or from which you use the Services.

4. Your Obligations as a User

As a user, you agree to comply with the following:

  • You will use the Services only for purposes that are permitted by the Terms and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions;
  • You have the sole responsibility for protecting the confidentiality of your login credentials;
  • Any use of your registration information by any other person, or third parties, is strictly prohibited. You agree to immediately notify UEC Equipment Hire of any unauthorised use of your credentials or any breach of security;
  • Access and use of the Website is limited, non-transferable and allows for the sole use of the Website by you for legitimate equipment hire purposes;
  • You will not use the Services or the Website for any illegal and/or unauthorised use which includes collecting contact information for unsolicited communications or unauthorised framing of or linking to the Website;
  • You acknowledge and agree that any automated use of the Website or its Services is prohibited.

5. Payment

All payments made in the course of your use of the Services are processed securely. Equipment hire fees, delivery charges, and any additional costs must be paid in accordance with our hire terms and conditions.

You acknowledge and agree that where a payment is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the failed payment.

You agree and acknowledge that UEC Equipment Hire can vary hire rates and fees at any time, with reasonable notice provided for existing bookings.

6. Cancellation and Refund Policy

UEC Equipment Hire operates the following cancellation policy:

  • 48 hours or more before hire commencement: Full refund of payments made
  • Less than 48 hours before hire commencement: 50% refund of hire fees
  • After hire commencement: No refund unless equipment is not of acceptable quality under Australian Consumer Law

Any benefits set out in these Terms and Conditions may apply in addition to consumer rights under the Australian Consumer Law.

7. Equipment Use and Safety

By using our Services, you acknowledge that:

  • All equipment must be operated by licensed operators only
  • Equipment must be used for its intended purpose and in accordance with manufacturer guidelines
  • You are responsible for ensuring safe site conditions and access
  • Equipment must not be used while the operator is under the influence of alcohol or drugs
  • You must immediately report any damage, theft, or safety incidents

8. Copyright and Intellectual Property

The Website, the Services and all related products of UEC Equipment Hire are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties.

All trademarks, service marks and trade names are owned, registered and/or licensed by UEC Equipment Hire, who grants to you a worldwide, non-exclusive, royalty-free, revocable licence to:

  • Use the Website pursuant to the Terms;
  • Copy and store the Website and material in your device's cache memory; and
  • Print pages from the Website for your own personal and non-commercial use.

UEC Equipment Hire retains all rights, title and interest in and to the Website and all related Services.

9. Privacy

UEC Equipment Hire takes your privacy seriously and any information provided through your use of the Website and/or Services are subject to UEC Equipment Hire's Privacy Policy, which is available on the Website.

10. General Disclaimer

Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law.

Subject to this clause, and to the extent permitted by law:

  • All terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded; and
  • UEC Equipment Hire will not be liable for any special, indirect or consequential loss or damage, loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services.

Use of the Website and Services is at your own risk. Everything on the Website and Services is provided to you "as is" and "as available" without warranty or condition of any kind.

11. Limitation of Liability

UEC Equipment Hire's total liability arising out of or in connection with the Services or these Terms will not exceed the value of the equipment hire fees paid by you.

12. Competitors

If you are in the business of providing similar equipment hire services, then you are a competitor of UEC Equipment Hire. Competitors are not permitted to use or access any information or content on our Website for commercial purposes. If you breach this provision, UEC Equipment Hire will hold you fully responsible for any loss that we may sustain.

13. Termination

The Terms will continue to apply until terminated by either you or UEC Equipment Hire.

If you want to terminate the Terms, you may do so by providing UEC Equipment Hire with 7 days' notice via email to admin@uecivil.com.au.

UEC Equipment Hire may terminate the Terms with you if:

  • You have breached any provision of the Terms;
  • UEC Equipment Hire is required to do so by law;
  • The provision of Services to you is no longer commercially viable.

14. Dispute Resolution

If a dispute arises out of or relates to the Terms, the parties must:

  1. Notice: The party claiming a dispute must give written notice detailing the nature of the dispute and desired outcome.
  2. Resolution: Within 28 days of notice, parties must endeavour in good faith to resolve the dispute by negotiation.
  3. Mediation: If unresolved after 28 days, parties must agree on a mediator or request appointment of an appropriate mediator.
  4. Venue: Any mediation will be held in Brisbane, Queensland.

15. Venue and Jurisdiction

The Services offered by UEC Equipment Hire are intended to be viewed by residents of Australia. In the event of any dispute, you agree that the exclusive venue for resolving any dispute shall be in the courts of Queensland, Australia.

16. Governing Law

The Terms are governed by the laws of Queensland, Australia. Any dispute arising out of or relating to the Terms shall be governed and construed pursuant to the laws of Queensland, Australia.

17. Severance

If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
